PlayOn Cloud Customer Terms
PLAYON.TV AUSTRALIA CUSTOMER TERMS
The PlayOn Services ordered through this website are proudly provided by PLAYON.TV AUSTRALIA (ABN 84 637 530 968). The Services operate on the PlayOn platform provided by our technology partner in the USA, Mediamall Technologies, Inc (MMT). The Services are licensed for customer use under MMT’s End User License Agreement and Terms of Service. Those are to be read with the minimum necessary changes to apply to Australian customers (for example, the requirement to be resident in the United States does not apply). When you subscribe to the Services, you are agreeing to those terms both with MMT directly, and with us as if the references to MMT were references to us.
Fees – The Customer agrees to pay PLAYON.TV AUSTRALIA the fees for the Services shown on the PLAYON.TV AUSTRALIA website (https://playoncloud.com.au) at time of ordering the Services (Fees) and as updated from time to time. Our website may also set out special offers, subject to conditions. The Fees are payable in advance by direct debit.
Payment – You agree to pay the Fees by direct debit from the Account you nominate, through the payment method we make available from time to time. The payment method provider’s terms also apply to you. Other than as provided in these terms, Australian Consumer Law or other applicable laws, we are not liable for any issues with the payment method.
How to cancel your subscription – You can cancel your subscription by logging into your account on our website https://playoncloud.com.au and following the cancellation process.
If you submit your cancellation request 5 days or more prior to the end of a billing period, we will not take any more payments and the cancellation will take effect at the end of the current billing period.
If you submit your cancellation request less than 5 days prior to the end of a billing period, we will process one more payment and the cancellation will take effect at the end of the next billing period.
Cancellation requests must be submitted prior to 2:00p.m. AEST to be processed on the same day. Example: If you do not want us to take another payment, you must have submitted your cancellation request prior to 2:00p.m. AEST, 5 days before the end of the billing period.
You will be able to use any recording credits already purchased, even after your subscription has ended. However, you will not be able to purchase any new recording credits unless your subscription is current and active.
Refunds – You may be entitled to a full or part refund under Australian Consumer Law, if the Services do not work as intended. See our Refunds and Cancellations Policy for details. Other than as provided, the Services are provided on an “as-is” basis and our liability is limited to re-supplying the Services, or refunding Fees paid for faulty Services.
Account – You are responsible for all Fees incurred using your account. You may authorise another user to use your Account on your behalf, but you remain at all times the Customer. You may not transfer your Account to another person or entity. You are responsible for maintaining the confidentiality and security of your Account login details and must not disclose the Account login details to any third party other than an authorised user. You must notify us immediately if you have any reason to believe that your Account details have been lost, stolen or compromised.
General – The governing law and jurisdiction of these Customer Terms is Victoria, Australia. These Customer Terms prevail to the extent of inconsistency with the MMT terms.
